Terms of Use Holders VVV Gift Card

Intersolve EGI B.V., with its registered office at Fonteinkruid 4, 3931 WX Woudenberg and registered in the Trade Register of the Chamber of Commerce under number: 32159718 ("Intersolve EGI") is an Electronic Money Institution (within the meaning of Article 1:1 of the Financial Supervision Act (Wft)) that issues gift cards and processes the underlying payments made with the gift card. Intersolve EGI is registered as a licensed electronic money institution in the register of electronic money institutions of the Dutch Central Bank (http://www.dnb.nl/toezichtprofessioneel/de-consument-en-toezicht/registers/WFTEG/index.jsp). Intersolve EGI is supervised by both the Dutch Central Bank and the Netherlands Authority for the Financial Markets. The cashless funds that the Credit on a gift card represents are held by a separately established third-party funds foundation. The purpose of the Foundation is to separate the money received from the Holders that the Credit on the gift card represents from the assets of Intersolve EGI in order to guarantee payment to the Merchant of the issued Credit and to always be able to comply with the exchange obligation towards Holders as referred to in Article 4:31 of the Financial Supervision Act. The Credit on the VVV Gift Card issued by Intersolve EGI on which an e-money value is stored (hereinafter the "Gift Card") is electronic money issued by Intersolve EGI to You (the "Holder" of the Gift Card) under the brand of the relevant Program Manager (the organization behind the brand of the Gift Card, as found on the Intersolve EGI website). The Program Manager is not a party to the Agreement between the Holder and Intersolve EGI. 1. Definitions In these Terms of Use for the holder of the VVV Gift Card (hereinafter: 'Terms of Use'), the terms written with a capital letter have the following meanings: Acceptor: Company, institution and/or (internet) shop where the Holder can pay with the Gift Card for goods to be delivered, services to be provided or the use of any goods, see the Program Website for a list of Merchants; Sale: Program Website: Credit: The official points of sale listed on the Program Website; The Programme Manager's website where the Holder can find information about the Gift Card in question; The amount (in euros) of electronic money available on the Holder's Gift Card. 2. Applicability and handing over 2.1. All legal relationships between Intersolve EGI and the Account Holder are subject to these Terms of Use. It is not possible for Intersolve EGI to provide the Holder with the text of the Terms of Use in writing before or at the time of the purchase of the Gift Card (i.e. the conclusion of the Agreement). At the time of purchase, the Holder has expressly agreed that the Terms of Use will be made available to him by electronic means. The Terms of Use are available for inspection at Intersolve EGI, can be consulted on the website www.intersolve.nl and the Program Website and have been filed with the Chamber of Commerce. Upon first request, they will be sent to the Account Holder free of charge without delay. 2.2 The Holder who has purchased the Gift Card from a Point of Sale is entitled to return the Gift Card to Intersolve EGI within three days of the purchase, upon presentation of proof of purchase, and to request Intersolve EGI in writing to pay the Credit, if that Holder: (i) does not agree with the content of the Terms of Use; (ii) it deems it objectionable that the Terms of Use have not been made available to it in writing before or at the latest at the time of purchase of the Gift Card; or (iii) wishes to revoke its express agreement that the Terms of Use may be made available to him by electronic means.
